Using E Acad
Who May Use our Services
You may use our Services only if you can form a binding contract with E Acad, and only in compliance with these Terms and all applicable laws. When you create your E Acad account, and subsequently when you use certain features, you must provide us with accurate and complete information, and you agree to update your information to keep it accurate and complete. Any use or access by anyone under the age of 5 is prohibited, and certain regions and Content Offerings may have additional requirements and/or restrictions.
Our License to You
Subject to these Terms and our policies (including the Acceptable Use Policy, Honor Code, and course-specific eligibility requirements, and other terms), we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use our Services. You may download content from our Services only for your personal, non-commercial use unless you obtain E Acad written permission to otherwise use the content. You also agree that you will create, access, and/or use only one user account, unless expressly permitted by E Acad, and you will not share with any third party access to or access information for your account. Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access.
The Services enable you to share your content, such as homework, quizzes, exams, projects, other assignments you submit, posts you make in the forums, and the like ("User Content"), with E Acad, instructors, and/or other users. You retain all intellectual property rights in, and are responsible for, the User Content you share. User Content does not include course content or other materials made available on or placed on to the E Acad platform by or on behalf of E Acad Content Providers or their instructors using the Services, the Content Offerings; as between E Acad and its Content Providers, such Content Offerings are governed by the relevant agreements in place between E Acad and its Content Providers.
How E Acad and Others May Use User Contents
To the extent that you provide User Content, you grant E Acad a fully-transferable, royalty-free, perpetual, sublicensable, non-exclusive, worldwide license to copy, distribute, modify, create derivative works based on, publicly perform, publicly display, and otherwise use the User Content. This license includes granting E Acad the right to authorize Partners to use User Content with their registered students, on-campus learners, or other learners independent of the Services. Nothing in these Terms shall restrict other legal rights E Acad may have to User Content, for example under other licenses. We reserve the right to remove or modify User Content for any reason, including User Content that we believe violates these Terms.
We welcome your suggestions, ideas, comments, and other feedback regarding the Services ("Feedback"). By submitting any Feedback, you grant us the right to use the Feedback without any restriction or any compensation to you. By accepting your Feedback, E Acad does not waive any rights to use similar or related Feedback previously known to E Acad, developed by its employees or contractors, or obtained from other sources.
We care about the security of our users. While we work to protect the security of your account and related information, E Acad cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorized use of your account by emailing
Third Party Content
Through the Services, you will have the ability to access and/or use content provided by instructors, other users, and/or other third parties and links to websites and services maintained by third parties. E Acad cannot guarantee that such third party content, in the Services or elsewhere, will be free of material you may find objectionable or otherwise inappropriate or of malware or other contaminants that may harm your computer, mobile device, or any files therein. E Acad disclaims any responsibility or liability related to your access or use of, or inability to access and use, such third party content.
Copyright and Trademark Policy
E Acad respects the intellectual property rights of our users, Content Providers, and other third parties and expects our users to do the same when using the Services. We have adopted and implemented the E Acad Copyright and Trademark Policy in accordance with applicable law.
E Acad is committed to advancing the science of learning and teaching, and records of your participation in courses may be used for education research. In the interest of this research, you may be exposed to variations in the Content Offerings. Research findings will typically be reported at the aggregate level. Your personal identity will not be publicly disclosed in any research findings without your express consent.
Paid Services from E Acad
E Acad offers paid Services (e.g., Course lectures for certain courses) for a fee. Unless otherwise stated, all fees are quoted in Indian Rupees. You are responsible for paying all fees charged by or for E Acad and applicable taxes in a timely manner with a payment mechanism associated with the applicable paid Services. If your payment method fails or your account is past due, we may collect fees using other collection mechanisms. Fees may vary based on your location and other factors, and E Acad reserves the right to change any fees at any time at its sole discretion. Any change, update, or modification will be effective immediately upon posting through the relevant Services. Refunds may be available for paid Services as described in our Refund Policy.
Modifying and Terminating our Services
We are constantly changing and improving our Services. We may add or remove functions, features, or requirements, and we may suspend or stop part of our Services altogether. Accordingly, E Acad may terminate your use of any Service for any reason. If your use of a paid Service is terminated, a refund may be available under our Refund Policy. We may not be able to deliver the Services to certain regions or countries for various reasons, including due to applicable export control requirements or internet access limitations and restrictions from governments. None of E Acad, its Content Providers and instructors, its contributors, sponsors, and other business partners, and their employees, contractors, and other agents (the "E Acad Parties") shall have any liability to you for any such action. You can stop using our Services at any time, although we'll be sorry to see you go.
THE SERVICES AND ALL INCLUDED CONTENT ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THE E ACAD PARTIES SPECIFICALLY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. THE E ACAD PARTIES FURTHER DISCLAIM ANY AND ALL LIABILITY RELATED TO YOUR ACCESS OR USE OF THE SERVICES OR ANY RELATED CONTENT. YOU ACKNOWLEDGE AND AGREE THAT ANY ACCESS TO OR USE OF THE SERVICES OR SUCH CONTENT IS AT YOUR OWN RISK.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE E ACAD PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY PARTY OTHER THAN THE APPLICABLE E ACAD PARTY, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR INFORMATION. IN NO EVENT SHALL E ACAD AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED TWENTY U.S. DOLLARS ($20) OR THE TOTAL AMOUNT OF FEES RECEIVED BY E ACAD FROM YOU FOR THE USE OF PAID SERVICES DURING THE PAST SIX MONTHS, WHICHEVER IS GREATER.
YOU AGREE THAT ANY CAUSE OF ACTION RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
You agree to indemnify, defend, and hold harmless the E Acad Parties from any and all claims, liabilities, expenses, and damages, including reasonable attorneys' fees and costs, made by any third party related to: (a) your use or attempted use of the Services in violation of these Terms; (b) your violation of any law or rights of any third party; or (c) User Content, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.
Governing Law and Jurisdiction
The Services are managed by E Acad, which is located in Ahmednagar, Maharashtra. You agree that any dispute related to these Terms will be governed by the laws of the State of Maharashtra, excluding its conflicts of law provisions. You further consent to the personal jurisdiction of and exclusive venue in the federal and state courts located in and serving Ahmednagar, Maharashtra as the legal forum for any such dispute.
Revisions to the Terms
We reserve the right to revise the Terms at our sole discretion at any time. Any revisions to the Terms will be effective immediately upon posting by us. For any material changes to the Terms, we will take reasonable steps to notify you of such changes, via a banner on the website, email notification, another method, or combination of methods. In all cases, your continued use of the
Services after publication of such changes, with or without notification, constitutes binding acceptance of the revised Terms.
If it turns out that a particular provision of these Terms is not enforceable, this will not affect any other terms. If you do not comply with these Terms, and we do not take immediate action, this does not indicate that we relinquish any rights that we may have (such as taking action in the future).
E Acad Content Providers, and integrated services providers are third party beneficiaries of the Terms and may enforce those provisions of the Terms that relate to them.
Acceptable Use Policy
Effective: April 1, 2020
E Acad mission is to provide universal access to the world’s best education. We believe strongly in preserving free speech and expression for our users as well as academic freedom for our Content Providers and instructors. We also want to make sure that all of our users and instructors feel safe and comfortable while using our Services. We have drafted this Policy to ensure that people understand and follow the rules when participating in our online community and otherwise using our Services.
We may remove or edit inappropriate content or activity identified by or reported to us or suspend, disable, or terminate a user's access to all or part of the Services.
You are prohibited from using our Services to share content that:
Contains illegal content or promotes illegal activities with the intent to commit such activities.
Please keep in mind that users who are as young as 13 use E Acad, and we do not allow content that is inappropriate for these younger users.
Contains credible threats or organizes acts of real-world violence. We don’t allow content that creates a genuine risk of physical injury or property damage, credibly threatens people or public safety, or organizes or encourages harm.
Harrasses others. We encourage commentary about people and matters of public interest, but abusive or otherwise inappropriate content directed at private individuals is not allowed.
Violates intellectual property, privacy, or other rights. Do not share content that you do not have the right to share, claim content that you did not create as your own, or otherwise infringe or misappropriate someone else’s intellectual property or other rights. Always attribute materials used or quoted by you to the original copyright owner.
Spams others. Do not share irrelevant or inappropriate advertising, promotional, or solicitation content.
You also aren't allowed to:
Do anything that violates local, state, national, or international law or breaches any of your contractual obligations or fiduciary duties.
Share your password, let anyone access your account, or do anything that might put your account at risk.
Attempt to access any other user's account.
Reproduce, transfer, sell, resell, or otherwise misuse any content from our Services, unless specifically authorized to do so.
Access, tamper with, or use non-public areas of our systems, unless specifically authorized to do so.
Break or circumvent our authentication or security measures or otherwise test the vulnerability of our systems or networks, unless specifically authorized to do so.
Try to reverse engineer any portion of our Services.
Try to interfere with any user, host, or network, for example by sending a virus, overloading, spamming, or mail-bombing.
Use our Services to distribute malware.
Use our Services or any functionality of the E Acad platform for anything other than for completing online courses or for pedagogical purposes.
Impersonate or misrepresent your affiliation with any person or entity.
Encourage or help anyone do any of the things on this list.
Copyright and Trademark Policy
Effective as of April 1, 2020.
E Acad respects the intellectual property rights of our Content Providers, instructors, and other third parties and expects our users to do the same when using the Services. We reserve the right to suspend, disable, or terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights, trademarks, or other intellectual property rights of others.
E Acad also respects the trademark rights of others. Accounts with any other content that misleads others or violates another's trademark may be updated, suspended, disabled, or terminated by E Acad in its sole discretion. If you are concerned that someone may be using your trademark in an infringing way on our Services, please email us at support@E Acad.org, and we will review your complaint. If we deem appropriate, we may remove the offending content, warn the individual who posted the content, and/or temporarily or permanently suspend or disable the individual’s account.
Effective as of April 1, 2020.
For Month-to-Month Subscriptions
E Acad does not offer refunds for payments made on a month-month subscription plan. To avoid being charged during a free trial promotion, you must cancel your subscription before your free trial ends. If you complete a course during the free trial period, E Acad reserves the right to require you to pay for a one-month subscription in order to receive a Course and/or Specialization Certificate if the course comes with certification.
Your subscription will continue on a month-to-month basis unless and until you cancel or the subscription is suspended or discontinued by E Acad. For subscriptions to individual Specializations, E Acad will automatically discontinue your subscription at the end of the monthly period during which you earn a Specialization Certificate for the Specialization unless you have subscribed through a third-party marketplace that restricts E Acad ability to do so. You must cancel your subscription before your monthly renewal date to avoid the next billing.
If you cancel your subscription, the cancellation will be effective at the end of the current monthly period; you will have continued access to your subscription for the remainder of that period, but you will not receive a refund.
For E Acad Courses
There will be no refund against a purchase on courses from EAcad once the memory card/ pen drive or tablet is received by the user and no technical problem is observed in the device. Any damage to the device will lead to a violation of refund policy terms and no refund will be processed for such cases. No refund will be made if users change the originality of the device by unlocking it or encrypting it and an immediate ban on all the services will be applied to the user.
For E Acad Old Study Materials
Old study Material store does not include EACAD’S products and EAcad is not responsible for refunds related to such products. All the products are added by site members and we receive a 5% commission on that. For such transactions, it is advisable to order products using cash on a delivery system. If any issue is with the order quality or wrong order, EAcad should not be held responsible for that. Customers, however, have the right to file complaints against the person from whom they received the order and in such case, EAcad will help them providing full information of the seller.
For EAcad Online Stationary
Stationary includes all the newly sold books, notebooks, and all materials which come under school and college study purpose. A full refund will be provided if the item is returned within 1st seven days of delivery. No return or refund will be accepted once this period of seven days is over. Customers can also replace the item if wishes but in 1st seven days of delivery of the order. The refund will also be processed for damaged or faulty products in the 1st 7 days of delivery. No refund will be processed if the damage is caused by the customer's side. No claim for refund will be considered in any situation once the period of seven days is over.

All students purchasing the course must abide by the following
I will register for only one account unless expressly permitted to register for additional accounts by E Acad.
My answers to homework, quizzes, exams, projects, Test series, and other assignments will be my own work (except for assignments that explicitly permit collaboration).
I will not make solutions to homework, quizzes, exams, projects, and other assignments available to anyone else (except to the extent an assignment explicitly permits sharing solutions). This includes both solutions written by me, as well as any solutions provided by the course staff or others.
I will not engage in any other activities that will dishonestly improve my results or dishonestly improve or hurt the results of others.
I will not share my courses purchased with anyone else.
I will not unlock the device or encrypt it until my course is completed. If such a thing happens, EAcad has full right to stop my plan and no refund will be processed for this.

Compliance with these Terms
These Terms apply to you if you are a user of PIP BOOK anywhere in the world.
Please review these Terms and our policies and instructions to understand how you can and cannot use PIP BOOK. You must comply with these Terms in your use of PIP BOOK and only use PIP BOOK as permitted by applicable laws and regulations, wherever you may be when you use them. In some countries, there are restrictions on your use of PIP BOOK – it is your responsibility to ensure that you are legally allowed to use PIP BOOK where you are located, and certain PIP BOOK functionalities may not be available in some countries.
By using PIP BOOK, you agree to these Terms. If you do not agree to these Terms, you must not use PIP BOOK.
Other general terms in relation to these Terms
If you are under the age of 13, you must not use PIP BOOK. If you are between the ages of 13 and 18 (or the relevant age in your jurisdiction where you are considered a minor), your parent or guardian must agree to these Terms (both for themselves and on your behalf) before you can use PIP BOOK.
If you are using PIP BOOK on behalf of a company, partnership, association, government or other organization (your “Organisation”), you warrant that you are authorized to do so and that you are authorized to bind your Organisation to these Terms. In such circumstances, “you” will include your Organisation.
We may translate these Terms into multiple languages. If there is any difference between the English version and any other language version of these Terms, the English version will apply (to the extent permitted by applicable laws and regulations).
For the purposes of these Terms, any reference in these Terms to "PIP BOOK" refers to PIP BOOK and all PIP BOOK-related services provided by or on behalf of us or our affiliate companies from time to time, including the following services:
PIP BOOK Mini Programs Platform;
PIP BOOK Developers Platform;
Official Account Admin Platform;
PIP BOOK Out; and
PIP BOOK Pay
PIP BOOK Social Platform
PIP BOOK Peer to Peer Messaging
ADDITIONAL TERMS AND POLICIES
We offer a diverse range of services and features within PIP BOOK, so there are additional terms and policies that may be applicable to your use of all or part of PIP BOOK (the "Additional Terms"). We will notify you of the Additional Terms from time to time, including as set out in this section and otherwise from time to time within PIP BOOK. These Additional Terms all form part of and are incorporated into these Terms.
PIP BOOK policies
The following policies are Additional Terms that you must comply within using PIP BOOK:
PIP BOOK Acceptable Use Policy – which sets out rules of good behavior applicable to your use of PIP BOOK.
Terms applicable to specific PIP BOOK features
Some of our services and features have Additional Terms specific to their use. You must comply with such Additional Terms (as well as these Terms) in your use of such services and features. Such service-specific Additional Terms include:
Sticker Licence Agreement – governing your use of Stickers (as defined in such agreement) within PIP BOOK.
PIP BOOK Developers Platform Use Agreement – governing your use of the PIP BOOK Developers Platform.
PIP BOOK Official Account Admin Platform User Agreement – governing your use of the PIP BOOK Official Account Admin Platform.
PIP BOOK Out Terms of Service – governing your use of PIP BOOK Out.
PIP BOOK Pay System User Service Agreement – governing your use of PIP BOOK Pay.
We may make changes to these Terms (and any applicable Additional Terms) over time (for example, to reflect technical improvements and changes to PIP BOOK (for example, to address a security threat) or applicable laws and regulations (for example, to reflect applicable consumer rights)), so please come back and review these Terms regularly.
Where we consider that such changes are reasonably material, we will (where reasonably practicable) notify you (via https://www.eacad.org/, direct communication to you, on this page or the relevant page for the relevant additional terms or policy, or other means), prior to such changes becoming effective. By continuing to use PIP BOOK after we make any changes to these Terms, you are agreeing to be bound by the revised Terms.
CHANGES TO PIP BOOK
As PIP BOOK and user experiences are constantly evolving, we may from time to time:
add, change or remove features or services from PIP BOOK (including in relation to whether a feature or service is free of charge or not); and/or
suspend, discontinue or terminate PIP BOOK altogether.
You agree that we may take any such actions at any time. Where we consider that any changes to PIP BOOK or any services or features accessible within PIP BOOK are reasonably material, we will (where reasonably practicable) notify you (via https://www.eacad.org/, direct communication to you, on this page or the relevant page for the relevant additional terms or policy, or other means), prior to such changes becoming effective.
You need to create an account with us in order to access and use PIP BOOK. Any account that you open with us is personal to you and you are prohibited from gifting, lending, transferring or otherwise permitting any other person to access or use your account. Your account name, user ID and other identifiers you adopt within PIP BOOK remains our property and we can disable, reclaim and reuse these once your account is terminated or deactivated for whatever reason by either you or us.
You are responsible for: (a) safeguarding your account details, including any passwords used to access your account and PIP BOOK, and (b) all use of PIP BOOK under your account, including any purchases made and/or payment obligations arising under your account. You must promptly notify us by visiting https://www.eacad.org/ if you know or suspect that your password or account has been compromised. We will regard all use of your account on PIP BOOK as being by you, except where we have received a valid and –properly received notification to us regarding your account or password being compromised.
We may allow you to register for and log in to PIP BOOK using sign-on functionalities provided by third-party platforms, such as Facebook or Google. You agree to comply with the relevant third-party platform's terms and conditions applicable to your use of such functionalities (in addition to these Terms).
You may, from time to time, make payments to us or third-parties as part of your use of PIP BOOK (including for the provision of PIP BOOK or provision of certain additional features within PIP BOOK). We may set out further terms applying to such payments (including in relation to refunds (if any), billing arrangements and any consequences of failing to make timely payments). You must comply with all such terms in relation to your payments to us. You agree that you are solely responsible for all fees and taxes associated with any such payments. and that pricing and availability of Items and products are subject to change at any time.
We may from time to time make available payment methods to you for automatic, recurring or subscription-based charges. Where we do so, you agree that (subject to applicable laws and regulations):
such purchases or payments are generally made by you on an advance basis. Unless the purchase was on a subscription basis, we will notify you prior to any automatic renewals;
you authorize us to (a) save your chosen payment method's information (e.g. credit card information) on our systems, and (b) bill your chosen payment method for the relevant time-periods as chosen by or notified to you;
if any payment made via your chosen payment method is rejected, denied or returned unpaid for any reason: (a) we may not provide you with, or suspend our provision of, the relevant PIP BOOK product or service until payment is properly processed; and (b) you are liable to us for any fees, costs, expenses or other amounts we incur arising from such rejection, denial or return (and we may automatically charge you for such amounts); and
we will provide you with further instructions within PIP BOOK regarding how you may update or cancel the relevant payment method.
We may change any fees that we charge for PIP BOOK (or any parts of PIP BOOK) at any time upon publication within PIP BOOK. If you do not accept such change to the fees, we may be unable to provide PIP BOOK (or the relevant part of PIP BOOK) to you.
SUBJECT TO MANDATORY APPLICABLE LAWS AND REGULATIONS OR AS OTHERWISE SPECIFIED BY US IN THESE TERMS OR FOR A PARTICULAR ITEM OR SERVICE WITHIN PIP BOOK, IN NO CIRCUMSTANCES WILL WE BE REQUIRED TO PROVIDE A REFUND FOR ANY PAYMENTS MADE BY YOU TO US IN RELATION TO ANY ITEMS OR SERVICE WITHIN PIP BOOK (WHETHER USED OR UNUSED).
If you believe that we have charged you in error, and subject to applicable laws and regulations: (a) you must contact us within 30 days of the date of the relevant charge; and (b) no refunds will be given for any erroneous charges after such 30 days period. We may process payments from you in PIP BOOK via a third-party service, and we may provide your relevant Information to such third parties to process your payments. You agree to comply with that relevant third party's terms and conditions in relation to the payment processing service, as further set out in the "Third Party Content and Services" section below.
When you submit, upload, transmit or display any data, information, media or other content in connection with your use of PIP BOOK (“Your Content”), you understand and agree that:
you will continue to own and be responsible for Your Content;
we will not sell Your Content to any third party;
you grant other PIP BOOK users a non-exclusive license to access and use Your Content within PIP BOOK, in accordance with these Terms and PIP BOOK's functionalities;
we may use the name that you submit in connection with Your Content (whether that be your account name, real name or otherwise); and
you will comply with these Terms, including our PIP BOOK Acceptable Use Policy, in your submission of Your Content.
are allowed to retain and continue to use Your Content after you stop using PIP BOOK;
may be required to retain or disclose Your Content: (a) in order to comply with applicable laws or regulations; (b) in order to comply with a court order, subpoena or other legal processes; (c) in order to respond to a lawful request by a government authority, law enforcement agency or similar body (whether situated in your jurisdiction or elsewhere); or (d) where we believe it is reasonably necessary to comply with applicable laws or regulations, in each case whether such applicable law or regulation, legal process or government body is of your jurisdiction or elsewhere;
may be required to retain or disclose Your Content in order to enforce these Terms or to protect any rights, property or safety of ours, our affiliate companies or other users of PIP BOOK.
We reserve the right to block or remove Your Content for any reason, including as is in our opinion appropriate, as required by applicable laws and regulations or in accordance with the Copyright Policy. We reserve the right to artificially manipulate the visibility, status, or rank of Your Content on PIP BOOK.
Responsibility for Your Content
You are solely responsible for Your Content. We are not responsible for maintaining a backup of Your Content - we recommend that you keep a back-up copy of it at all times.
You must at all times ensure that: (a) you have the rights required to copy, process, transmit, access, publish, display and use Your Content, and to grant us and other third parties the rights as set out in these Terms; and (b) Your Content (and our use of Your Content in accordance with these Terms) does not infringe or violate any applicable laws or regulations or the rights of any person.
THIRD-PARTY CONTENT AND SERVICES
We are not responsible for and we do not endorse, support or guarantee the lawfulness, accuracy or reliability of any content submitted to, transmitted or displayed by or linked by PIP BOOK, including content provided by users of PIP BOOK or by our advertisers. In order for us to provide PIP BOOK to you, we may require virtual access to and/or use of your relevant device (e.g. mobile phone, tablet or desktop computer) that you use to access PIP BOOK – for example, we may need to use your device's processor and storage to complete the relevant PIP BOOK installation, or we may need to access your contact list to provide certain interactive functions within PIP BOOK.

APART FROM THIS WARRANTY, TO THE EXTENT PERMITTED BY APPLICABLE LAWS AND REGULATIONS, PIP BOOK (INCLUDING ANY PIP BOOK ) IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND NEITHER US NOR ANY OF OUR AFFILIATE COMPANIES MAKE ANY REPRESENTATION OR WARRANTY OR GIVE ANY UNDERTAKING IN RELATION TO PIP BOOK, ANY PIP BOOK OR ANY DATA, MEDIA OR OTHER CONTENT SUBMITTED, TRANSMITTED OR DISPLAYED BY PIP BOOK, INCLUDING (A) ANY REPRESENTATION, WARRANTY OR UNDERTAKING THAT PIP BOOK OR PIP BOOK WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE OR FREE FROM VIRUSES; (B) THAT PIP BOOK OR PIP BOOK WILL BE COMPATIBLE WITH YOUR DEVICE; OR (C) THAT PIP BOOK OR PIP BOOK WILL BE OF MERCHANTABLE QUALITY, FIT FOR A PARTICULAR PURPOSE OR NOT INFRINGE THE INTELLECTUAL PROPERTY RIGHTS OF ANY PERSON. TO THE EXTENT PERMITTED BY APPLICABLE LAWS AND REGULATIONS, YOU WAIVE ANY AND ALL IMPLIED REPRESENTATIONS, WARRANTIES AND UNDERTAKINGS.
LIABILITY FOR PIP BOOK
TO THE EXTENT PERMITTED BY APPLICABLE LAWS AND REGULATIONS, THE TOTAL AGGREGATE LIABILITY OF US AND OUR AFFILIATE COMPANIES FOR ALL CLAIMS IN CONNECTION WITH THESE TERMS, OR PIP BOOK (INCLUDING ANY PIP BOOK ), ARISING OUT OF ANY CIRCUMSTANCES, WILL BE LIMITED TO THE GREATER OF THE FOLLOWING AMOUNTS: (A) THE AMOUNT THAT YOU HAVE PAID TO US FOR YOUR USE OF PIP BOOK OR PIP BOOK TO WHICH THE CLAIM RELATES IN THE 6 MONTHS IMMEDIATELY PRECEDING THE DATE OF THE MOST RECENT CLAIM, AND (B) USD100 (ONE HUNDRED US DOLLARS). TO THE EXTENT PERMITTED BY APPLICABLE LAWS AND REGULATIONS, IN NO EVENT, WILL WE OR ANY OF OUR AFFILIATE COMPANIES BE LIABLE FOR ANY OF THE FOLLOWING:
IN CONNECTION WITH THESE TERMS OR PIP BOOK OR PIP BOOK, FOR ANY DAMAGES OR LOSSES, CAUSED BY (A) ANY NATURAL DISASTER SUCH AS FLOODS, EARTHQUAKES OR EPIDEMICS; (B) ANY SOCIAL EVENT SUCH AS WARS, RIOTS OR GOVERNMENT ACTIONS; (C) ANY COMPUTER VIRUS, TROJAN HORSE OR OTHER DAMAGE CAUSED BY MALWARE OR HACKERS; (D) ANY MALFUNCTION OR FAILURE OF OUR OR YOUR, SYSTEM, HARDWARE OR CONNECTIVITY; (E) IMPROPER OR UNAUTHORISED USE OF PIP BOOK OR PIP BOOK ; (F) YOUR USE OF PIP BOOK OR PIP BOOK IN BREACH OF THESE TERMS; (G) ANY REASONS BEYOND OUR REASONABLE CONTROL OR PREDICTABILITY; OR (H) FAILURE TO SAVE OR BACK UP ANY DATA OR OTHER CONTENT;
ANY LOSS ARISING FROM ANY CONTENT, PROGRAMS OR SERVICES PROVIDED BY ANY PARTY OTHER THAN US (OR OUR AFFILIATES);
ANY LOSS OR DAMAGE WHICH ARE NOT FORESEEABLE, INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES OR LOSSES. FOR THE PURPOSES OF THIS CLAUSE, LOSS OR DAMAGE IS FORESEEABLE IF EITHER IT IS OBVIOUS THAT IT WILL HAPPEN OR IF, AT THE TIME THE CONTRACT WAS MADE, BOTH WE AND YOU KNEW IT MIGHT HAPPEN; AND/OR
LOSS OF USE;
LOSS OR INTERRUPTION OF BUSINESS;
LOSS OF REVENUES;
LOSS OF PROFITS;
LOSS OF GOODWILL;
LOSS OR DESTRUCTION OF CONTENT OR DATA.
Nothing in these Terms limits or excludes any of the following liabilities, except to the extent that such liabilities may be waived, limited or excluded under applicable laws and regulations:
any liability for fraud;
any liability for negligently caused death or personal injury;
any liability for gross negligence or wilful misconduct; or
any other liability to the extent that such other liability cannot be waived, limited or excluded under applicable laws and regulations.
NOTWITHSTANDING ANY OTHER PROVISIONS OF THESE TERMS, NOTHING IN THESE TERMS LIMITS OR EXCLUDES ANY OF YOUR STATUTORY RIGHTS IN YOUR JURISDICTION (INCLUDING ANY RIGHTS UNDER APPLICABLE CONSUMER PROTECTION REGULATION), TO THE EXTENT SUCH STATUTORY RIGHTS MAY NOT BE EXCLUDED OR WAIVED UNDER APPLICABLE LAWS AND REGULATIONS.
YOU AGREE THAT YOU (AND YOUR ORGANISATION, IF YOU ARE USING PIP BOOK OR PIP BOOK ON BEHALF OF SUCH ORGANISATION) INDEMNIFY US AND OUR AFFILIATE COMPANIES FROM AND AGAINST ANY CLAIM, SUIT, ACTION, DEMAND, DAMAGE, DEBT, LOSS, COST, EXPENSE (INCLUDING LITIGATION COSTS AND ATTORNEYS’ FEES) AND LIABILITY ARISING FROM (A) YOUR USE OF PIP BOOK OR PIP BOOK; OR (B) YOUR BREACH OF THESE TERMS.
NO LIABILITY FOR THIRD PARTIES
As set out in the "Third Party Content and Services" and "Third Party " sections of these Terms, various third parties may provide certain content, services or PIP BOOK.
THESE TERMS GOVERN THE RELATIONSHIP BETWEEN YOU AND US (AND, WHERE RELEVANT, OUR AFFILIATE COMPANIES). YOUR DEALINGS WITH ALL THIRD PARTIES (INCLUDING THOSE FOUND THROUGH, PROMOTED THROUGH, ACCESSED VIA HYPERLINK THROUGH OR OTHERWISE THROUGH PIP BOOK), ARE SOLELY BETWEEN YOU AND THE RELEVANT THIRD PARTY. SUBJECT TO MANDATORY APPLICABLE LAWS AND REGULATIONS, WE AND OUR AFFILIATE COMPANIES HAVE NO LIABILITY TO YOU IN RELATION TO ANY THIRD PARTIES (INCLUDING ANY CONTENT, SERVICES OR PROVIDED BY SUCH THIRD PARTIES WITHIN PIP BOOK), NOTWITHSTANDING YOUR ENGAGEMENT WITH ANY SUCH THIRD PARTIES THROUGH PIP BOOK.
These Terms will apply to your use of PIP BOOK until your access to PIP BOOK is terminated by either you or us.
You may terminate your use of PIP BOOK, or any of the services accessible therein, at any time (including if we have told you about an upcoming change to all or part of PIP BOOK or these Terms which you do not agree to). If the terminated service is a paid service, we may deduct from any refund a reasonable proportion of such fee as compensation for the costs incurred by us in ending the relevant service.
We may suspend or terminate your access to your account or any or all of PIP BOOK:
if we undertake maintenance or support of PIP BOOK;
to make changes to PIP BOOK as notified by us to you;
if we reasonably believe that you have breached these Terms;
if your use of PIP BOOK creates risk for us or for other users of PIP BOOK, gives rise to a threat of potential third-party claims against us or is potentially damaging to our reputation;
if you fail to use PIP BOOK for a prolonged period;
if such suspension or termination is required due to Applicable Laws; or
to the extent permitted by applicable laws and regulations, for any other reason in our sole and absolute discretion,
and where reasonably practicable, we will give you advance notice of any suspension or termination.
If we suspend your access to any or all of PIP BOOK then, to the extent permitted by applicable laws and regulations in your jurisdiction: (a) you remain responsible for all fees accrued through the date of suspension (including where the fees were incurred before suspension date but performance of the relevant obligations were after the suspension date); and (b) you remain responsible for any applicable fees for any part of PIP BOOK to which you continue to have access.
If your access to PIP BOOK is terminated (in whole or in part) by you or us, you agree that: (a) all of your rights under these Terms will terminate; (b) you remain responsible for all fees accrued through the date of termination (including where the fees were incurred before termination date but performance of the relevant obligations were after the termination date); and (c) you will immediately permanently delete all copies of PIP BOOK to which the termination relates and you will immediately cease accessing and using any such PIP BOOK .
Retention and back-up of Your Content
Subject to the applicable laws and regulations in your jurisdiction, these Terms set out the entire agreement between you and us in relation to PIP BOOK – you agree that you will have no claim against us for any statement which is not explicitly set out in these Terms. The words "include" and "including" are to be construed without limitation. The invalidity of any provision of these Terms (or parts of any provision) will not affect the validity or enforceability of any other provision (or the remaining parts of that provision). If a court holds that we cannot enforce any part of these Terms as drafted, we may replace those terms with similar terms to the extent enforceable under applicable laws and regulations, without changing the remaining terms of these Terms. No delay in enforcing any provision of these Terms will be construed to be a waiver of any rights under that provision. Any rights and obligations under these Terms which by their nature should survive, including any obligations in relation to the liability of, or indemnities (if any) given by, the respective parties, will remain in effect after termination or expiration of these Terms.
No person other than you and us will have any right to enforce these Terms, whether pursuant to the Contracts (Rights of Third Parties) Ordinance or otherwise, and you may not delegate, assign or transfer these Terms or any rights or obligations under these Terms without our prior consent. We may freely assign or transfer these Terms or our rights and obligations under these Terms, in whole or in part, without your prior consent or prior notice to you. We may freely sub-contract any part of our performance of these Terms at any time, without your prior consent or prior notice to you.

Every year scholarship exam will be conducted for each class as published in the website for which Rs100/- will be charged for making all the arrangements for smoothly conducting the examinations. The mode of examinations will be conveyed every year to registered candidates via mail and text messaging. Those who fail to appear for the scholarship exam due to their negligence will be responsible for their loss and no refund will be provided to such individuals.
The minimum criteria for providing free education to 2 students from each class will be applicable only if the number of students appearing for the exam from each class will be 50.
